(5) It is said that about one in five children in urban areas like Baltimore are affected by lead poisoning. Lead is particularly harmful to children under the age of 6.

I know from my intense representation of divorce clients very successfully for over 35 years in both Montgomery and Howard counties, as well as many other in-state and out-of-state jurisdictions.
In many marriages a series of stressful events can occur when the parties divorce, particularly when children are involved. As a result, the emotions involved with the changes that occur in divorce can frequently impair the parties efforts to make sound decisions. Along with having good attorneys on both sides, getting through a divorce may be easier if you are better informed generally about the process before it even begins. The following are just a few of many tips I give my clients to help them make it through this difficult process :
(1) In reality, no person actually and truly "wins" in a divorce; therefore, it is not a prudent attitude to expect to "win" your divorce. The better attitude for a person is, with my help, to expect to "successfully survive" your divorce.
(2) Do not make important or critical decisions in the divorce process without carefully thinking them through and without consulting your divorce attorney.
(3) Always remember: you and your spouse are the ones divorcing --- not your children. Saying cruel things about your estranged spouse around your children is not helpful for the children.
(4) I have found that every divorce I have been involved in, or know of, is or was unique, specifically in facts. Therefore, it is not a good idea to believe or act upon everything other people say to you about their divorce --- or even about your divorce.
(5) Through your divorce process, try to keep your eyes on the "big picture" (the significant goals you wish to attain, etc.).

In the July 1904 edition of its monthly publication, major paint manufacturer Sherwin Williams reported on the dangers of paint containing lead pigments, citing French researchers' conclusion that lead paint was " poisonous in large degrees, both for workmen as well as inhabitants of houses painted with lead colors" [ " Dangers of White Lead", by Richard Guenther, 02/24/1904, Hathitrust].
Nevertheless, when lead-based paint was marketed and sold (white lead paint was used since Colonial Times) in the area now known as America --- before it was banned by the Federal Government (Consumer Product Safety Commission) in 1978 --- it was a legal product in great demand because it was, inter alia, washable and durable. It was repeatedly endorsed by the Federal, state, and local governments, and specified for use on government buildings until the mid-1970s. DUI field sobriety tests ("FSTs") are inaccurate. A key reason FSTs are inaccurate is because they are "subjective" in nature, and subject to the whims, mood, competence, capability, attitude, training, agenda and fairness of the police officer administering the tests or interpreting the results.

One of the best, and most unfortunate, defenses for landlords against lead paint liability is the fact that lead is essentially everywhere in the earth's environment : in the air we breathe, the water we drink and use, soil, plants, food and drink compounds, cooking utensils, ceramics and pottery, industrial sites, buildings, furniture and toys, etc. In so-called civilization we cannot escape the presence of lead (Pb).
However, I recommend that prudent landlords be aware, at least, of the following tips:
1. If you are going to be a landlord for residential rental properties built in the United States before 1978 (particularly in large metropolitan areas like Baltimore, Philadelphia, New York City and Boston, etc.) learn the laws, rules and regulations regarding lead paint abatement, etc.
2. Good maintenance of the rental property is absolutely crucial.
3. Lawful and adequate notice to tenants is mandatory.
4 Good, long-term record-keeping/documentation about the property and tenants (tenant file) is very important.
If you, as a landlord, cannot follow these basic tips --- then do not become the landlord

Recent studies, however, are indicating that Baltimore and Maryland state officials are overlooking a major source of toxic lead in Baltimore's environment : the soil.
Academic researchers are finding that soil-lead concentrations in old communities of large cities such as Baltimore is 10 to 100 times greater than comparable neighborhoods of smaller cities. In addition, soil-lead concentrations diminish with distance from a city center. For example, in the inner city of Baltimore, where soil-lead concentrations are highest, Baltimore had mostly unpainted brick buildings, since its inner city underwent a large fire in 1904. On reconstruction, the new building codes required the use of fireproof (thus, brick) construction materials. The sites of old housing constructed with lead painted wood siding are located in outlying parts of the city, where the lead content of the soils is lowest.
Since Baltimore is a large metropolitan East Coast city which historically boomed with a heavy industrial-plant presence which used abundant amounts of lead --- and since lead is a heavy earth metal (Atomic Number 82) which is renowned for its long life span --- it makes sense that over time large amounts of lead would settle in Baltimore's soil. <more>

In March of 2008, Maryland law enforcement began a statewide drunk driving enforcement campaign called " Checkpoint Strikeforce" ( No-it was NOT a Jackie Chan movie). As part of the effort police departments would start placing "Drunk Driver Enforcement Zone" banners on roadsides in the state where sobriety checkpoints and police saturation patrols would occur. The program has expanded since that time.
Apparently the goal was, when motorists see the "Drunk Driving Enforcement Zone" banners they can be sure police are in that area looking for drunk drivers (actually, not a bad idea). No subterfuge here by law enforcement. But, drivers cannot be lax. Police continue to employ all of their other law enforcement strategies and techniques to warn the public and make DUI arrests.
To my knowledge, Maryland is the first jurisdiction to engage this campaign. I have no definitive sense at this time of its success or failure.

Furthermore, in some circumstances, this law could allow marital assets needed post-divorce, for such things as housing costs, to be divided sooner rather than later.

In 1955 the paint industry, under pressure from public health officials and organizations, adopted a "voluntary" national standard to prohibit the use of lead pigments in interior residential paints. Through the 1950s and 1960s, the use of exterior lead-based paint declined significantly, and ended by the early 1970s. In 1971, the Federal Lead Poisoning Prevention Act was passed. In 1978, the Federal government (via the Consumer Product Safety Commission) banned consumer uses of lead paint all together. As uses of lead pigments in paints evolved, so did the primary pathways through which children were thought to be exposed to lead and the level of exposure thought to be "safe". It was not until about 1974 or so that household dust began to emerge as a possible pathway for lead exposure in children and adults.

MODERN HOWARD COUNTY MARYLAND DIVORCE : 3 NEW LAWS

There are three(3) new Maryland Divorce Laws that were enacted in 2015 which make the divorce process in Howard County more convenient.
The first law clarifies and simplifies the circumstances in which a married couple can get a limited (partial) )divorce.. This law removes elements of the limited divorce grounds that required voluntariness of the separation and the absence of any reasonable expectation of reconciliation. That is, this law recognizes that if the parties no longer live together, and one of them no longer wants to continue the marriage relationship, neither a court nor the state of Maryland should prevent the limited divorce process.
The second new law reduces the time from one year to six months the time needed for one of the parties to reside in Maryland if the grounds (legal basis) for divorce occurred outside of the state of Maryland.
The third new divorce law creates an entirely new ground ("legally good enough" reason) for divorce. It essentially allows a couple who have worked out all the terms to their divorce , and who have no children in common, to avoid waiting up to a full year before asking the court for a divorce. This law allows divorce with no waiting period where a couple with no children in common have settled all issues in a WRITTEN and SIGNED AGREEMENT that is presented to the court.
