Montgomery County and Howard County are probably two of the "better" (more progressive) jurisdictions in Maryland in judicially handling DUI and DWI cases. However, be ever mindful that Maryland is still very much a state that takes DUI and DWI violations very seriously.
To keep it simple and distinguish the two "drunk driving" offenses, remember:
(1) The DUI, or "Driving Under the Influence" of alcohol, occurs when your blood alcohol concentration (BAC) is 0.08 % or above; and
(2) A blood alcohol concentration (BAC) of 0.07 or less of alcohol generally qualifies as a DWI ("driving While Impaired).
