MARYLAND DUI REPORT : FACTORS AFFECTING DUI BREATHALYZER ACCURACY

There are at least six (6) factors that can affect DUI breathalyzer accuracy:

1. HUMAN ERROR. Possibly the most frequent factor. As allegedly easy as breathalyzers are to use, they still require some human attention to detail.
2. CALIBRATION. Breathalyzers must be calibrated periodically batteries must be replaced in a timely manner in order to maintain accuracy.
3. CONSISTENCY. To assist with accuracy, breath tests should be performed multiple times to produce alleged reliable results.
4. SOFTWARE. Breathalyzers run on software, just as computers rely on operating systems. Consequently, occasionally there are bugs and glitches in their operation.
5. ENVIRONMENTAL FACTORS. False results are frequently triggered by the presence of substances such as paint fumes, varnish, and chemicals such as plastics and adhesives.
6. FOREIGN SUBSTANCES. Substances present in mouth of the person that contain alcohol can frequently produce false positives because the amount of alcohol vapor these substances emit may be greater than the amount exhaled from the lungs.
