                             DEFINITION OF "PLUMBISM" or LEAD POISONING

Plumbism or lead poisoning is an acute or chronic poisoning of the body caused by the absorption of lead or any of its salts .

Plumbism or lead poisoning is an environmental hazard that is capable of causing mental retardation, behavioral disturbance, and brain damage. In the United States, lead poisoning is formally defined as at least 10 micrograms of lead per deciliter of blood in the body. It is more common in children than in adults because young children often put their hands and other objects in their mouths, and these objects can have lead dust on them. Additionally, plumbism is more dangerous in children than in adults because children absorb more lead and the developing brain and nervous system are more sensitive to the damaging effects of lead.

Lead was used in household paint in Baltimore and elsewhere in the U.S. up until 1978 when it was outlawed by the Federal government, and it was also found in leaded gasoline, some types of batteries, water pipes and other plumbing, toys, ceramics, home remedies, furniture, etc.  Lead paint and pipes are still found in many older residential units in Baltimore, and lead is all too often found in drinking water, food, household dust, furniture, toys, home remedies and soil.

Lead can also be a workplace hazard for employees in certain industries.  A diet that is high in iron and calcium can help protect  people against absorbing lead. Treatment of lead poisoning involves chelation therapy, whereby blood is removed from the body and metals are filtered out through a machine, then reinfused into the patient.

                                          BALTIMORE   LEAD  INGESTION

Lead exposure in the general population of Baltimore (including children) occurs primarily through ingestion, although inhalation also contributes to lead body burden and may be the major contributor for workers in lead-related jobs.

Lead paint chips, peels and dust are major sources, though not the only sources, of lead exposure for children.  As older lead paint deteriorates, peels, chips, or is removed (e.g., by renovation, etc.) or pulverized due to friction (e.g., in windowsills, steps and doors), house dust and surrounding soil may become contaminated.  Lead then enters the b ody through normal hand-to- mouth activity.

Ingestion of contaminated food, drinking water or alcohol may be significant for some populations.  In addition, ingesting certain home remedies as medicines may expose people to lead or lead compounds.

Besides residential units, dust, plumbing, drinking water, furniture, toys, etc., concentrations of lead can be found as well in Baltimore's inner-city soils.

In a 1983 scientific study, soil samples were randomly collected from 422 vegetable gardens centered in downtown Baltimore, Maryland, having a geographic radius of 48.28 km (30 miles). The levels of lead, four other metals (cadmium, copper, nickel, and zinc), and pH were measured for each location.
The concentrations of all of these were high.

The study concluded, inter alia, that these concentrations of lead and other metals in the soil pose environmental and public health issues, especially to children living within the inner-city of Baltimore.

Breathalyzer machines for determining BAC (Blood Alcohol Concentration) in DUI and DWI cases are not infallible. They can be wrong, and frequently are.

There are several factors that can affect the accuracy in results of the standard breathalyzer machine. The following are just a few of these factors:

(1)  HUMAN ERROR is the most common factor. These delicate machines require attention to detail by the operators in handling properly and getting accurate results.
(2) CONSISTENCY is required with these DUI machines to ensure accuracy. Breath tests should be performed multiple times (at least three times at a minimum) to produce a reliable result.
(3) ENVIRONMENTAL FACTORS> False results can be triggered by these machines in the presence of a host of contaminants such as paint fumes, varnish, smoke, and chemicals such as plastics and adhesives.
(4) SOFTWARE. Breathalyzers run on special software, just as computers rely on operating systems, which can result in occasional bugs and glitches They are delicate instruments, and certainly not perfect machines.
(5) CALIBRATION.  Breathalyzers must be calibrated periodically and batteries must be replaced in order to maintained accuracy.
(6) FOREIGN SUBSTANCES.  Substances present in the mouth (besides alcohol) as well as alcohol in substances in the mouth can produce false positives in the machine because, inter alia, the amount of alcohol vapor they emit may be greater than the amount exhaled from the lungs.  For example, some mouthwashes, breath fresheners, and toothache medicines contain alcohol and can skew readings.

                                   MARYLAND ADULT LEAD EXPOSURE
Generally, here in Maryland as well as throughout the nation, adult lead poisoning arises out of occupational exposure --- not from residential units.  Most cases of occupational lead poisoning occur through inhalation.  That is, plaintiffs' lead poisoning is allegedly a direct result of unsafe lead-involved work conditions, the negligence of the defendant on the job, or violation of various individual state statutes that require employers to provide adequate protection for workers to avoid exposure to lead.

Even in occupational cases, however, it is important to explore and investigate whether the plaintiff could have been exposed by any other source, including hobbies such as pottery/ceramics, auto repair, stained glass/painting, printmaking, hunting/target shooting, and playing games with lead figures.

THE COGNITIVE MANIFESTATIONS OF ELEVATED BLOOD LEAD LEVELS IN CHILDREN:

Expert witnesses for both plaintiff and defense in lead paint cases rely on the findings of neuropsychologists who have performed batteries of comprehensive neurological tests. Based on neuropsychological testing, plaintiffs' experts may testify to cognitive or intellectual deficits in the form of low IQ', delayed speech (often seen in male children), or deficiencies, or that variances (or scatter) in one or more of the tested areas reflect brain damage.

On the other hand, defense experts point to the findings as being representative of results found in the population of children who have certain neurological or medical disorders unrelated to toxic lead.

Chronic lead poisoning occurs over a longer period of time --- several weeks, months, even years.                      LEAD PAINT --- " THE INSIDIOUS CONTAMINANT "

In 1991, the Centers for Disease Control (CDC) observed that " it is unlikely that there is a single predominant source of lead exposure " for young children. Nevertheless, experts for plaintiffs in lead paint poisoning litigation continue to claim that the  most common causes of lead exposure are very small particles of lead-based paint peeling from walls, ceilings, and other surfaces and combining with household dust.  [ See, U.S. DEPT. OF HEALTH AND HUMAN SERVICES, PUBLIC HEALTH SERVICE, CENTERS FOR DISEASE CONTROL, PREVENTING LEAD POISONING IN YOUNG CHILDREN ( OCT. 1991), Chapter 4 ]

This dust, CDC states, contaminates all surfaces, including a mobile child's hands, fingers, skin, scalp, clothes, and toys and, through normal hand-to-mouth activity is absorbed into the child's bloodstream.  All other (and there are many) potential sources of exposure, such as exposure in utero, recent immigration from foreign countries still using leaded gasoline, or use of ceramics or cosmetics containing lead, or plumbing fixtures, etc., are often erroneously dismissed by plaintiffs' experts as significant exposure sources. They should not be.

 lead is frequently considered the " ubiquitous contaminant ". Succinctly, it's everywhere.

Virtually all persons in industrial civilizations have some lead in their bodies due to the ubiquitous nature of lead in the environment.  Lead is found in many consumer products manufactured in the United States and in foreign countries. Products containing lead include jewelry, toys, cribs, high chairs, cosmetics, and lunchboxes.

In fact, in the 2000s, many toys were recalled by the Consumer Product Safety Commission when they were found to be contaminated with lead. Consumers and children can also be exposed to lead through imported pottery, candles, or Mexican or Asian folk remedies, which may contain high con-
centrations of lead.  Additionally, lead particles or dust can be brought into the home from contaminated work clothes, plumbing, playgrounds, et al.,  and lead to exposure for humans.

Despite all these potential sources of contamination, however, most lead paint litigation arises out of the exposure of children to housing built before 1950 when lead was banned in residential ( as opposed to industrial) paint. In 1978, lead was banned in all  paint in the U.S.

Proper maintenance and documentation are key for lead poisoning prevention in residential units.

According to THE LINE * , Korea (presumably South Korea) is the latest fast-rising plastic surgery consumer destination, joining such popular medical tourism destinations as Thailand ( which has for years been famous for its low-cost sex-change surgeries, among others). These medical tourism hot spots are popular for their surgeries allegedly because of their lower medical costs, exotic(?) geographic locations, and "special services"  for visiting patients such as resort hotel accomodations, airport pick-ups and drop-offs,, multilingual websites and guides and emails, video consultations, and other conveniences.

But, what about the legal risks when medical errors and omissions occur. Frequently, when surgical mistakes occur the foreign medical tourism patient suffers legally from the foreign countries' use of medical disclaimers, waivers , distance, and other contractual devices patient are often unaware of which give them very little legal recourse. Caveat Emptor: America's medical malpractice laws are generally not applicable abroad.

Thailand, for example, is one of the more popular medical tourism destinations that makes it extremely difficult for their patients (both Thai and foreign) to file medical malpractice lawsuits
in the country. It is also difficult in Korea --- even with it's " rising obsession" with plastic surgeries such as nose jobs (rhinoplasty), double eyelid surgeries, and jaw bone surgeries.

                                       ANXIETY

ANXIETY is a psychological response to stressors that have both physiological and psychological components. The behavioral reactions to anxiety are influenced by psychosocial-cultural factors ( gender, age, race, color, ethnicity, employment, religion, nationality, immigration status, et al.), basic personality development, past experiences ( with law enforcement, other authority figures, et al.), cultural and religious values,  and even economic status, among other things such as, of course, anatomical, medical and health-related experiences.

                            ANXIETY  AND  THE  DUI  STOP

While mild anxiety may result in increased alertness, anxiety can --- and frequently does --- increase to a stage where the subjects (our clients) can suffer from the recognized psychological signs of anxiety such as decreased attention span, decreased ability to follow directions, increase in the number of questions asked, and the need to seek reassurance.  Many who suffer from severe stress response may actually exhibit immobility.  These are the very symptoms that may cause a person who is not under the influence of alcohol to perform poorly on the standardized alcohol field sobriety tests; in stark contradiction to police officers' frequent standard testimony that DUI defense clients were " not acting normally", " wanted to fight", were " uncooperative", " could not follow instructions", etc., etc., etc.

Alcohol is frequently not the cause of such behavior by the suspect, but instead the suspect's autonomic nervous system response to the anxiety directly resulting from the stop by the police officer and the suspect's understandable and reasonable fear of the resulting circumstances ( be the known or unknown).
