After many years of stagnation, there are now three (3) new laws from the recent 2015 Maryland General Assembly that significantly affect Maryland divorce.:
1. The first new law reduces the time from one year to six months for the minimum time the parties must reside in Maryland if the grounds (legal basis) for divorce occurred outside of the State of Maryland.
2. The second new law removes elements of the limited divorce ground that required voluntariness of the separation and the absence of any reasonableness expectation of reconciliation. In other words, it recognizes that if the parties no longer live together, and one of them no longer wants to continue the marriage relationship, neither a court nor the State of Maryland should prevent the limited divorce process.
3. The third new divorce law is a brand new ground (legally sufficient reason) for divorce. Let's call it "mutual consent". The law allows divorce with no waiting period where a couple with no children in common have settled all issues in a written and signed agreement that is presented to the court.
