In an effort to reduce potential lead paint claims and assist in the defense of claims being pursued, we recommend that landlords adopt the following measures:
1. Before renting a house or apartment to new tenants, require the prospective tenant to disclose the names and ages of all persons who will reside in the apartment. Document this information.
2. Inspect the apartment or house with the prospective tenant and require the tenant to sign an inspection sheet confirming that each room is free of peeling, flaking, or other defective paint conditions.
3. Conduct periodic inspection of each apartment and follow the same procedure with respect to the maintenance of inspection sheets signed by tenants.
4. Treat all complaints of peeling or flaking paint conditions as emergencies requiring immediate attention.
5. Retain MDE-licensed and insured contractors with experience in the field to perform any required abatement work.
6. Paint residences (especially inside) every 3 years and maintain copious records of all maintenance, repair, and paint work performed within each residential unit.
7. If denied access to an apartment to perform an inspection or maintenance work, document the denial within the tenant's folder and follow up with a letter to the tenant confirming the failure to gain access to the apartment.

U.S. President Donald Trump has declared his intentions to immediately revoke (or has already revoked) the temporary protected status (TPS) of 60,000 Haitian immigrants and 200,000 Salvadoran immigrants, as well as 2,500 Nicaraguan migrants. This means these immigrants must either leave voluntarily by certain deadlines to be determined, or be deported. A six-month TPS extension was allegedly recently granted to 57,000 Hondurans.
Temporary Protected Status, or TPS, is a temporary immigration status granted to certain eligible aliens who are nationals or citizens of certain designated countries who cannot return home because of a crisis in their home country (or parts thereof) that is recognized as such by section 244 of the Immigration and Nationality Act (INA); Immigration Act of 1990 ("IMMACT"), P.L. 101-649, et al.
TPS was established by Congress in the Immigration Act of 1990. It is a humanitarian program whose basic principle is that the United States should suspend deportations to countries that have been destabilized by war or catastrophe. Under current law, the secretary of homeland security can extend TPS protections as a result of ongoing armed conflict, an environmental disaster, or "other extraordinary and temporary conditions" [USCIS]. Foreign nationals with TPS protections are generally able to obtain work authorization and a driver's license, but the TPS designation is subject to U. S. government review and can only be extended for up to 18 months. Salvadorans are by far the largest group of TPS holders.

Because of its historical connection with lead (Pb) in residences, industrial and commercial use, and even government buildings, Baltimore is considered "ground zero" for lead paint lawsuits. In fact, Baltimore was the first large metropolitan area in the United States to bar residential lead paint (in the 1950's). It was in 1978 that the federal government outlawed consumer and residential use of lead paint. Since the 1950's in Baltimore, then, the key points for residential rental landlords in Baltimore have been (1) knowledge of local, state and national lead paint rules, laws and statutes; (2) compliance with these rules, laws and statutes; (3) proper notice to tenants; (4)proper maintenance of rental properties; and (5) good record-keeping.
In Baltimore, lead(Pb) can be found in a variety of sources, including among others:
- Paint in homes built before 1978.
- Water pumped through leaded pipes.
- Imported items such as clay pots, some food items, pots and pans, toys, cosmetics, etc.
- Certain consumer products such as some Mexican candies, candles, make-up, jewelry, etc.
- Certain imported home remedies, etc.
The potential or actual Baltimore residential property landlord should be aware of the following, inter alia:
- If the rental house was built before 1950, the house (if not occupied by the owner) falls under the Reduction of Lead in Housing Act, which protects tenants and imposes certain duties on landlords.
In addition, owners of houses built between 1950 and 1978 may also participate in this lead poisoning prevention.
- A good resource and reference is the Maryland Department of the Environment (MDE) "Lead Line" website.
- A shared feature of Federal and Maryland state lead poisoning laws is that both require landlords to give tenants the pamphlet, "Protect Your Family from Lead in Your Home."
- Maryland law also requires distribution by landlords of an additional pamphlet titled "Lead Poisoning Prevention - Notice of Tenants' Rights".
- Routinely and consistently check the property for chipping, peeling or flaking paint.
