From my many successful years of practicing law I have observed that, no matter one's personality or training or demeanor, divorce can be traumatic for the parties and others affected --- especially the children. The divorce process can also be very frequently uncivil . We try to be as civil as the process will allow us in these contested cases. It may be helpful for persons seeking divorce in Maryland to understand that the State of Maryland traditionally has a reputation as conservative and paternalistic in the context of its divorce laws. Traditionally, Maryland has been among the last states to adopt updated uniform state laws addressing various issues within the arena of divorce and family law. BUT, THAT HAS NOW CHANGED :
Three (3) new 2015 Maryland laws are now in effect that radically affect divorce in this state
These new laws essentially grant more authority to Maryland residents to decide for themselves when and how they can divorce.
(1) The first new law reduces the time from one year to 6 months the time needed for one of the parties to reside in Maryland if the grounds (legal reasons) for divorce occurred outside of the State of Maryland.
(2) The second new law removes elements of the "limited divorce" ground that required voluntariness of the separation and the absence of any reasonable expectation of reconciliation. In other words, this law recognizes that if the parties no longer live together and one of them no longer wants to continue the marriage relationship, neither a court nor the state of Maryland should prevent the limited divorce process.
(3) I call the third new law the "mutual consent" ground for divorce, This law essentially allows a couple who have worked out all the terms to their divorce, and who have no children in common, to avoid waiting up to a full year before asking the court for a divorce. This law also potentially allows this sam ecouple, where finances are tight, to live in the same house while in the process of getting the divorce. Furthermore, in some circumstances, this law could allow marital assets needed post-divorce, for such things as housing costs, to be divided sooner rather than later.
When a marriage ends, spouses , their children and other family and friends, often face a whirlwind of chaos, conflict, stress and trauma.
