   ***  Numerous judges, state and local officials, and commentators have suggested
           that in certain circumstances lead poisoning are "indefensible" ***
     
           From my defense lawyer perspective, development of the lead paint defense
           begins when the landowner or landlord purchases the rental property.


           GOOD MAINTENANCE of the rental, ADEQUATE NOTICE to the tenants,
           and GOOD RECORD-KEEPING are paramount to successful avoidance of and
           prevailing in, lead paint claims and lawsuits.


           At a minimum, the following are documents for the landlord to maintain for each
           tenant and each  pre-1978 built rental property.


          1.  Tenant File;
          2.  Records of Tenant Complaints;
          3.  Property Repair Records;
          4. Maintenance Records;
          5. Names, etc., of Vendors;
          6. Names, etc., of Entities Retained to Insure Compliance with
              Federal, State, and Local Laws;
          7. Names of Persons Responsible for Repair and Maintenance of
              the rental property; and
          8. Lead Abatement Records.
