Lead (Pb) in residential comes from several different sources, including lead-based exterior paint
and automobile tailpipe emissions from vehicles burning leaded gasoline (now forbidden in the U.S.). Industrial emissions are also a source of residential lead-contaminated soil in some geographic areas.
The U.S. Environmental Protection Agency (EPA) has found building age to be a very strong statistical predictor of soil lead, with soil around private homes built before 1940 having higher levels of lead in soil than homes constructed between 1960 and 1979 [ U.S. Environmental Protection Agency (EPA), "Distribution of Soil Lead in the Nation's Housing Stock", 1996].
Though the consumer use of lead paint in residential buildings was Federally banned in the United States in 1978, many homes constructed prior to 1978 still contained some legacy (old) lead-based paint. Paint used in homes built between 1950 and 1978 contained between 0.5 and 50 percent lead, and the paint used prior to 1950 contained higher concentrations. One estimate is that more than three
million tons of lead-based paint remain in the 57 million homes built prior to 1980 [ Centers for Disease Control (CDC), " Preventing Lead Poisoning in Young Children", 1991 ].
Since a large portion of this lead-based paint covers building exteriors, it continues to be a significant source of lead in soil.
Lead-based paint can contaminate soil when the paint film weathers and reaches the soil in the form of chips and dust. Lead abatement or removal, renovating, remodeling, and performing routine apart-
ment and house maintenance can also mobilize this lead if proper care is not taken. As the paint on a building's exterior deteriorates, lead paint chips and dust can concentrate in the surrounding soil. Also, dry-scraping, sanding, and blasting of lead-based paint can mobilize large amounts of lead in a short time and significantly increase lead concentrations in soil. Lead concentrations in soil are typically highest in the "drip zone", or "drip line", which is the area surrounding and extending out about three feet from the perimeter of a building.

To the best of my research , significant mining and use of lead (Pb) began around 4,000 BC --- over 6,000 years ago. Large lead mines in ancient places such as Spain, Greece, etc., are known to have contributed significantly to the worldwide distribution of lead.
Lead is a malleable, utilitarian, heavy metal (Atomic Number 82), that does not dissolve in water, nor dissipate, nor decay, nor burn. Lead has been said to have a scientific "half-life" of over 500,000 years. Therefore, it lasts ... and lasts ... and lasts. Lead, in sufficient quantities, can also be harmful to the human body. Lead is said to be particularly harmful in infants and children under the age of 6. Which is one reason why there is so much litigation involving lead paint poisoning claims against landlords of pre 1978-built (old) apartments and houses throughout urban areas of the United States.
Because of its many years of mining and use, its durability, and its ability to last for such a long period of time, lead (Pb) has accumulated tremendously in the earth's environment. There are including the air we breathe, the water we drink and use, the food and liquids we consume, the soils and dust, plants,, and many of the products we have used, and currently use. As one source of many,
lead was also used in many residential units (house, etc.) in the United States which were constructed before 1978. Although lead was banned for many consumer products in the U.S. in 1978, be aware that this heavy metal is still being used prolifically in many other countries, and can be found in many of the products sold in the U.S. that come from these foreign countries.
Researchers estimate that about 10 billion pounds were used in the manufacture of paint in the United States between 1889 and 1970. While much of it is covered up, the lead paint that is exposed continues to deteriorate, posing an ongoing and potentially increasing health risk. Careful lead abatement (lead removal) by state and federally licensed, lead-certified contractors and workers is
absolutely necessary to protect both the tenant from harm as well as the landlord from claims.
Development of the lead poisoning defense begins when the landlord or landowner purchases the rental property. "Due diligence" is the phrase of the day here.
" Good maintenance" is obviously crucial. Too many landlords hold onto properties that are simply
not cost-effective to maintain. This issue is a major source of lawsuits.
" Adequate notice" to the tenant is required by law. Obey the law, and learn what your local, state and national notice requirements are.
" Competent record-keeping" is paramount. Keep both a tenant file as well as a property file --- or combine the two. In the current litigious lead paint-claim environment, I am forced to recommend that you keep(maintain or store) these files for at least 21 years [ until the statute of limitation runs out].

The State of Maryland permits recovery for wrongful death of a person. See, Section 3-901, et. seq., of the Courts and Judicial Proceedings Article of the Annotated Code of Maryland .
The primary beneficiaries in a wrongful death case are the spouse, parent and child of the deceased.
See, Section 3-904 (a). If there are no primary beneficiaries, the claim may be brought by any person related to the deceased by blood or by marriage who was substantially dependent upon the deceased.

Damages awarded are not restricted to economic loss and may include damages for mental anguish, emotional pain and suffering, loss of society, companionship, comfort, protection, marital care, parental care, filial care, attention, advice, counsel, training, guidance, or education ONLY if the deceased is a : (a) spouse; (b) child ; or (c) parent. Maryland appears to be making an effort to catch up to other states in the area of divorce.
Three new laws have been passed and are now in effect concerning divorce grounds and procedures :
(1) The first law reduces the time from one year to six months the time needed for one of the parties to reside in Maryland if the grounds (legal reason) for divorce occurred outside the State of Maryland.
(2) The second new law removes elements of the limited divorce ground that required voluntariness of the separation and the absence of any reasonable expectation of reconciliation. In other words, it recognizes that if the parties no longer live together and one of them no longer wants to continue the marriage relationship, neither a court nor the State of Maryland should prevent the limited divorce process.
(3) The third important change in Maryland divorce law is an entirely new ground (or legally good enough reason) for divorce. Basically, this new rule allows a couple who have worked out all the terms of their divorce, and who have no children in common, to avoid waiting up to a year before petitioning the court for a divorce. I call this new rule or procedure a "consent motion". This new process also potentially allows this same couple, where finances are tight, to live in the same house while in the process of a divorce.
