Under Maryland law, a driver can be charged with driving under the influence of alcohol (DUI) when his or her blood alcohol concentration (BAC) is measured at 0.08% or higher. A measurement under 0.08% (0.07% or lower) could subject the driver to a charge of driving while impaired with alcohol (DWI).


Maryland does not, generally, consider whether a driver's driving ability was actually impaired or not at the time of the stop by police. Instead, Maryland law only looks at   (1) whether the stop of the driver was lawful, (2) whether the driver was driving a motor vehicle at the time of the arrest, (3) that he or she consented to have their BAC measured, (4) that the driver's BAC  was indeed measured properly, and (5) that it was at a level higher of 0.08% or higher. This is considered to be a per se violation of DUI.
