Surprise ! In Maryland and every other jurisdiction in the United States, DUI breathalyzer devices are inaccurate.
One of the reasons these co-called "scientific instruments" are inaccurate is the very erroneous propaganda put out by manufacturers of these money-making devices that they are based upon testing of "the average person." This assertion is pure baloney and entirely fallacious.
The theory of the "average person" is one of the greatest sources of error in breath and blood-alcohol testing, with its consistently repeated fallacy that the individual tested is perfectly average in certain critical physiological traits. In other words, obtaining an accurate breath or blood-alcohol reading (BAC) is completely dependent on the validity of a number of scientific assumptions. Unfortunately for the person being tested, these assumptions are usually incorrect. The person tested is very rarely
"average" in event one of these critical characteristics, let alone in all of them.
Additionally, one of the lesser known and, thus, lesser mentioned causes of DUI breath test error is radio frequency interference ("RFI"). Breathalyzers can pick-up radio frequency interference ("RFI")
from certain devices such as cellphones, facsimile machines, police radios, AM & FM radios, fluorescent lights, walkie-talkies, security cameras,microwaves, etc.
