Starting January 1st, 2018 there are changes in effect to court rules in Maryland that are designed to help safeguard the personal and financial well-being of vulnerable Marylanders. The changes will apply to court-appointed guardians, guardianships and attorneys. Guardians are appointed by the court to make personal or financial decisions on behalf of someone who is unable to manage those matters because of age, disease or disability.
The new changes in court rules include the following:
(1) New certification requirements to be completed by physicians, psychologists, and licensed certified clinical social workers [ Amendments to Maryland Rule 10-202].
(2) New training and eligibility requirements for attorneys appointed to represent individuals who are the subjects of proceedings to establish guardianships [ Amendments to Maryland Rule 10-106 and the Maryland Guidelines for Court-Appointed Attorneys in Guardianship Proceedings ( attached as Appendix to Title 10)].
(3) New orientation and training requirements for guardians of the person and property [Amendments To Maryland Rule 10-108; new Maryland Rules 10-205.1 and 10-304.1; and the Guidelines for Court-Appointed Guardians of the Person and Guidelines for Court-Appointed Guardians of the Property 9attached as new appendices to Title 10)].
(4) New factors for courts to consider when determining whether good cause exists to appoint as a guardian an individual who has been convicted of an offense listed in Estates & Trusts Article, Section 11-114 ( new Maryland Rule 10-113).
(5) New factors for courts to consider when determining whether to require a guardian of the property to post a bond [ Amendments to Maryland Rule 10-702].

Because of its long history of lead (Pb) usage for residential, industrial and commercial purposes, the Baltimore metropolitan area is considered by many commentators to be "ground zero" for lead-based paint litigation. The metropolitan Mid-Atlantic and Northeast areas of the United States are considered by many to be "ground zero" for residential rental lead paint poisoning cases. These heavily-populated metropolitan centers include Baltimore, Washington, D.C., Philadelphia, New York and Boston, among others.
The reasons for this lead (Pb) concentration are several : the heavy concentration of pre-1978 built apartments and houses that were originally lead-based painted both inside and out; the heavy use of lead (Pb) in factories which abounded in these areas; the continued use of lead pipes, plumbing and water-containing utensils; and, of course, the extensive use of lead in government and commercial buildings, inter alia.
Unfortunately, since commercial paint manufacturers and the government have failed to come forward and assume an acceptable level of responsibility for medical and social injuries that have
occurred as a result of lead ingestion, the vast majority of these claims for lead -based paint damages are being brought against residential rental landlords; most of whom are the least prepared to handle these private and governmental lawsuits against them.
Too many new potential landlords do not engage in the necessary due diligence (research) before purchasing these pre-1978 built properties. The vast majority of already have some lead(Pb) in them; and many have never undergone lead remediation or even certified lead inspection. Simply, they do not know what they are getting into when they purchase the property and become the landlord for it.
Preparation, maintenance, notice and record-keeping are key points to always remember if you are a residential rental landlord for pre-1978 built properties in these metropolitan areas --- or desire to be.

Realistically, however, we know that once Halloween comes and the holiday season begins, almost endless opportunities abound for celebration and drinking --- which makes any plan of not drinking much more difficult to accomplish.
A few tips and reminders may be in order to help avoid your DUI or DWI arrest:
1. If you choose to drink, get a designated driver ( a sober friend, for example).
2. Or, get a taxicab, or Uber, etc., to transport you after the event.
3. Plan to stay at the host's (hostess') home overnight, or a friend nearby, or a hotel nearby, etc.
4. Stay home, party and drink.
5. If you are one of those persons determined to drink and drive, at least try to stay under the 0.08 % BAC level by doing the following :
- Eating food while you are drinking;
- Drinking lots of water; and
- Pacing your drinking.

There goes the Louisiana Supreme Court, again.
When many Americans say, in the vernacular, " I'll hit you up later, Dog", they are typically saying that they will contact the other person sometime later. They are not calling the person a "later dog."
The Louisiana courts, by now, should know that. Apparently, they do not.
When a 22-year old suspect in New Orleans, while being interrogated, told police detectives "just give me a lawyer, Dog", the police cleverly, but maliciously, miscommunicated his statement to say " just give me a lawyer dog." This miscommunication was, of course, ridiculous; but the highest court in Louisiana --- the Louisiana Supreme Court --- shockingly agreed with the police. The court ruled that the suspect was, in fact, asking for a "lawyer dog" and was not invoking his constitutional right to human legal counsel.
The suspect, Warren Demesme, was being interrogated by New Orleans detectives in October 2015 after two young girls claimed he had sexually assaulted them. It was the second time he had been brought in to the police station, and he was apparently getting frustrated. Demesme had repeatedly denied the crime; and finally he allegedly told the police [ as written and interpreted by the police] :
" This is how I feel, if y'all think I did it, I know that I didn't do it so why don't you just
give me a lawyer dog 'cause this is not what's up."
The particular punctuation by the police, arguably critical to Demesme's use of the sobriquet "dog", was gratuitous in this contextual vernacular --- and was suspiciously provided by the Orleans Parish District Attorney's office in a legal brief. It was then inappropriately adopted by Louisiana Associate Supreme Court Justice Scott J. Crichton.
It is unclear as to how many "lawyer dogs" there are in Louisiana.

The following scams and schemes are extraordinarily popular and successful. My advice is that you be aware of them, and obviously try to avoid them. Generally, if you have been made an investment offer that sounds too good to be true, then it probably is too good to be true. Therefore, it is most likely a scam to steal your money.
PONZI/PYRAMID SCHEMES are always suspect. Long before the name-sake for these scams, Charles Ponzi, was born, they were popular in some form in Europe. Famous writer Charles Dickens even described a version of this lucrative scheme in his novel, Little Dorrit, published in 1857. Ponzi/pyramid scams have probably stolen more money from victims than any other type of scam. A reason for this is because early investors, who are paid with the assets of later investors, believe they have a great investment; therefore, they tell family, friends and associates about it. Consequently, this Ponzi schemer-manufactured phenomenon of excitement creates many more (new) investors who provide the new assets needed by the scam operators to meet the withdrawals being made of early investors. Eventually, this gravy train ends tragically for many later investors. Ponzi schemers, such as Bernard Madoff, can perpetuate themselves and their schemes for decades as long as there are no excessive demands for distribution [Chapter 7: "From Charles Ponzi to Bernard Madoff --- The 'Ponzi' and Other Investment Schemes", from the book, LEGAL CONSUMER TIPS AND SECRETS : Avoiding Debtors' Prison in the United States, by Charles Jerome Ware].
INVESTMENT SEMINARS are frequently scams because the only people making any money from these seminars are the people who are presenting the seminars. Most of these seminars promote "get rich quick" schemes, which almost never succeed for most people. Avoid them.
UNREGISTERED INVESTMENTS (bearer bonds, etc.) are a no-no. Unregistered financial documents may "look real", but a potential investor should not assume they are. Lawful financial security documents must be registered with the proper regulatory agencies. Clever criminals can easily copy legitimate financial documents and pawn them off as real. If they are not properly registered, they are not real.
ANNUITIES can frequently be scams when financial advisors replace investors' current annuities with inferior annuity products. This is done by the advisor so that he or she can generate new rounds of commissions from the investors' assets [ Source: Paladin Research & Registry].
INVESTING IN PRECIOUS METALS is another popular and age-old scam. It can be as exotic as the scams of trading securities or currency manipulation. Simply put, like other scams the alleged gold or silver bullion the investor believes he or she is buying may not even exist. It can be, in effect, another Ponzi scheme. One reason for this scam's success is that the schemers know that most investors will not bother to insist on visiting the company headquarters or location where the alleged bullion is claimed to be stored.
The following scams and schemes are extraordinarily popular and successful. My advice is that you be aware of them, and obviously try to avoid them. PONZI/PYRAMID SCHEMES are always suspect. Long before the name-sake for these scams, Charles Ponzi, was born, they were popular in some form in Europe. Famous writer Charles Dickens even described a version of this lucrative scheme in his novel, Little Dorrit, published in 1857. Ponzi/pyramid scams have probably stolen more money from victims than any other type of scam. A reason for this is because early investors, who are paid with the assets of later investors, believe they have a great investment; therefore, they tell family, friends and associates about it. Consequently, this Ponzi schemer-manufactured phenomenon of excitement creates many more (new) investors who provide the new assets needed by the scam operators to meet the withdrawals being made of early investors. Eventually, this gravy train ends tragically for many later investors. INVESTMENT SEMINARS are frequently scams because the only people making any money from these seminars are the people who are presenting the seminars. Most of these seminars promote "get rich quick" schemes, which almost never succeed for most people. Avoid them.
UNREGISTERED INVESTMENTS (bearer bonds, etc.) are a no-no. Unregistered financial documents may "look real", but a potential investor should not assume they are. Lawful financial security documents must be registered with the proper regulatory agencies. Clever criminals can easily copy legitimate financial documents and pawn them off as real. If they are not properly registered, they are not real.
ANNUITIES can frequently be scams when financial advisors replace investors' current annuities with inferior annuity products. This is done by the advisor so that he or she can generate new rounds of commissions from the investors' assets [ Source: Paladin Research & Registry].
INVESTING IN PRECIOUS METALS is another popular and age-old scam. It can be as exotic as the scams of trading securities or currency manipulation. Simply put, like other scams the alleged gold or silver bullion the investor believes he or she is buying may not even exist. It can be, in effect, another Ponzi scheme. One reason for this scam's success is that the schemers know that most investors will not bother to insist on visiting the company headquarters or location where the alleged bullion is claimed to be stored.

(2) In some cases, you may have automatically become a U.S. citizen even if you were born outside the United States, if one or both of your parents were U.S. citizens when you were born. If you were not born in this country and you had a parent who was a U.S. citizen, you should talk to an experienced immigration lawyer or accredited representative to determine if you automatically became a U.S. citizen.
(3) If you had a green card and were under eighteen years old when one or both of your parents were or became U.S. citizens, you may have automatically become a U.S. citizen even if you were born outside the United States.
