Despite law enforcement's reliance on  breath testing devices to make their cases in most DUI and DWI stops, the fact remains --- in my professional experience --- that these instruments are insufficiently scientific, unreliable, inaccurate, and untrustworthy. Yet, many people's professional and personal lives are ruined everyday in our courts because of  the erroneous results of these "instruments."




Despite what the prosecution says, the "source codes" in these DUI breathalyzers are important in determining at least the minimal accuracy of them. "What is a source code?" I am glad you asked. The source code of a breath testing instrument is the bridge of communication between humans and computerized devices.  It is a collection of instructions from the programmer to the computer written in computer programming language. Because it is said the computer is not able to read or understand the source code, the source code is assembled by a compiler into "machine language", which is sometimes referred to as "object code."  Within the context of the source code issue and breath alcohol testing, every computer application has a source code.  In presenting a defense to the accuracy of the DUI breath testing device, the defendant needs the source code.
