Increasing case docket pressure on judges - leading to more civil settlements; stiffer sentences in criminal cases - leading to more plea bargaining; greater use of mediation and arbitration, et al., are adding up to the increasing disappearance of jury trials in the United States. The national law firm boutique of Charles Jerome Ware, Attorneys and Counselors, LLC, with the assistance and cooperation of the American Bar Association and several law schools, has created and impanneled the Charles Ware Jury Trial Project in Maryland and the District of Columbia to study this important issue on a nation-wide basis.
In 1962, there were 5,802 civil trials in the federal courts and 5,097 criminal trials, for a total of 10,899 federal jury trials. In 1985, total federal jury trials had risen to 12,529. In 2002, however, jury trials in federal courts had dropped to 4,569 in civil trials and 3,574 in criminal trials. Thus, our federal courts actually tried fewer jury trials in 2002 than they did in 1962, despite a five-fold increase in yhe number of civil filings and more than a doubling of the criminal filings over the same time frame. In 1962, 11.5 % of federal court cases were disposed of by jury trial. By 2002, that figure had dropped to 1.8 percent

1. Before purchasing a residential property that was built before 1978, determine the history or background of the property : including lead paint, asbestos, mold, lawsuits, major repair work, etc.
2. Hire qualified government-agency-certified ( e.g., Maryland Department of the Environment (MDE) , U.S. Environmental Protection Agency, etc.) workers for all lead-abatement work, etc.
3. If at all possible, acquire adequate lead poisoning liability insurance, and other appropriate insurance coverage.
4. Provide tenants at all times with lawful and proper "notice" of lead hazards and potential lead hazards, etc. [ see TITLE X (10), etc.].
5. Diligently repair and maintain the rental property at all times. Seek lead-free certification on the rental property.
6. Record and maintain precise tenant and property files.
7. Perform adequate background checks on all potential tenants.
8. Remember these 3 keys to being a successful landlord : (a) maintenance of the property, (b)notice to tenants, and (c) good record-keeping on both the tenant and the property.

Essentially, the new proposed FTC and DOJ Antirust Guidelines for Licensing of Intellectual Property re-enforce the two Federal agencies' (1) 1995 Antitrust Guidelines for the Licensing of Intellectual Property ("the IP Licensing Guidelines") and (2) the 2007 joint -report, titled Antitrust Enforcement and Intellectual Property Rights, Promoting Innovation and Competition ("the Antitrust IP Report").
In sum, the Federal Trade Commission (FTC) and the Department of Justice Antitrust Division's (DOJ's) views are that the IP Licensing Guidelines "remain soundly grounded" as a matter of antitrust law and economics in three basic principles:
A. The FTC and DOJ apply the same antitrust analysis to conduct involving intellectual property
as to conduct involving other forms of property, taking into account the specific characteristics of a particular property right.
B. The agencies do not presume that intellectual property creates market power.
c. The two agencies recognize that intellectual property licensing allows firms to combine complementary factors of production and is generally pro-competitive.

One of the more costly mistakes Baltimore residential rental landlords make is not engaging due diligent research of the history of the property prior to purchasing it. This includes not determining
definitively whether the property was built before 1978 [the year the Federal government outlawed lead paint use in residences in the United States].
A second costly mistake is the landlord not inspecting, repairing and maintaining the property in a diligent manner; paying particular attention to signs of lead, mold, asbestos, etc.
A third mistake is the landlord not using qualified, insured, Maryland Department of the Environment (MDE) or Environmental Protection Agency (EPA)- certified workers for all lead abatement work, or other hazardous removal work on the property.

MARYLAND'S NEW DRUNK DRIVING LEGISLATION --- " NOAH 's LAW " ---
GOES INTO EFFECT ON OCTOBER 1st, 2016
The new law --- The Drunk Driving Reduction Act of 2016 (NOAH's LAW) significantly expands the State of Maryland's MVA Ignition Interlock Program in an effort to keep drunk drivers off the State's roads.
An ignition interlock is a device that prevents a vehicle from starting when it detects a certain level of alcohol on the driver's breath. The law mandates an ignition interlock device for convicted drivers. The convicted driver is required to participate in the program for the following convictions:
(1) Driving Under the Influence (DUI);
(2) Driving While Impaired (DWI) while transporting a minor under the age of 16; and
(3) Homicide or life-threatening injury by motor vehicle while DUI or DWI.
The length of time the convicted driver is required to participate in the program is:
(1) For the first incident, it is 6 months.
(2) For the second incident, it is one year.
(3) And, for the third or subsequent incident, it is 3 years.
If the driver receives a DWI after refusing to take a chemical test ( a mandatory interlock is required) he or she will be required to participate in the ignition interlock program for one year.

In recognition of the health problems caused by lead poisoning, The Federal Government created the Residential Lead-Based Paint Hazard Reduction Act, commonly known as TITLE X (10), and enacted it in 1992 (42 U.S.C. 4852d). In the Act, Congress directed the Environmental Protection Agency (EPA) and the Department of Housing and Urban Development (HUD) to write regulations specifying how TITLE X's goal of lead hazard reduction should be accomplished (24 CFR Part 35 and 40 CFR Part 745).
The TITLE X regulations apply to rental property built prior to 1978.
The regulations specify that, among other things, before signing a lease or rental agreement, you must give every new tenant the EPA pamphlet, Protect Your family From Lead In Your Home. Both the landlord and the tenant must sign an EPA-approved form --- Disclosure of Information on Lead-Based Paint and/or Lead-Based Hazards --- that will prove that the landlord told the tenant about any known lead-based paint or lead-based paint hazards. Alternatively, the landlord may use similar forms approved by the State but is consistent with the EPA model.
The landlord must keep the executed disclosure form as part of their tenant records for at least three years from the date of the start of the tenancy.

Effective now in Maryland, there are three new laws that update (so to speak) Maryland divorce.
(1) The first new law reduces the time from one year to six months the required time needed for one of the divorcing parties to reside in the State of Maryland if the grounds (legal reasons) for the divorce occurred outside of Maryland.
(2) The second new law clarifies and simplifies the circumstances in which a couple can get a limited divorce. This law removes elements of nthe limited divorce ground that required voluntariness of the separation and the absence of any reasonable expectation of reconciliation. In sum, this law recognizes that if the parties no longer live together and one of them no longer wants to continue the marriage relationship, neither a court nor the State of Maryland should prevent the limited divorce process, which is --- of course --- limited in scope
(3) The third new law creates an entirely new ground (legal reason) for divorce in this state. The law essentially permits a couple who have worked out all of the terms of their divorce, and who have no children in common, to avoid waiting for up to a year before seeking permission from the court for a divorce. The new law also potentially allows this same couple, where finances are tight, to live in the same residence while in the process of a divorce. In some circumstances, this might allow marital assets needed post-divorce, for such things as housing costs, to be divided sooner than the normal one-year separation, etc.

The Physiology of Intoxication
Ethanol, or ethyl alcohol (grain alcohol), is one of the earliest and most widely used drugs in existence. It is a clear fluid whose low molecular weight and high solubility in water cause it to diffuse rapidly through body tissue membranes and reach equilibrium in tissue at levels proportional to water content. Blood, for example, will hold proportionately more alcohol than will muscle tissue.
For alcohol to produce its effect, it must reach the brain. To accomplish this, it must first pass into the blood stream after absorption through the walls of the stomach and small intestines. This is a simple biochemical process of of diffusion, which will continue as long as the concentration of alcohol in the stomach and intestines is higher than that in the blood.
Blood alcohol analysis, then, is simply the attempt to measure the amount by weight of alcohol within the subject's blood at any given time. This amount, expressed as a percentage of the blood in which it is found, is then compared to a scale of percentages established by law for determining the presumptive levels of intoxication.

As a defendant, you will want that videotape.
Increasingly, for some unknown reasons, police are failing to mirandize suspects in DUI cases. This is illegal.
It is generally recommended as protocol that police conduct a proper and reasonable observation of the suspect for,say, at least twenty minutes before administering the breath test This observation period lends more credibility to the validity of the test.
The police officer must be properly trained to administer all drunk driving tests, whether they be field sobriety test or machine tests. Police are frequently improperly trained.

The police officer must be properly trained to administer all drunk driving tests, whether they be field sobriety test or machine tests. Police are frequently improperly trained.
