In my many years of defending clients in DUI and DWI cases, I have learned and used numerous
on behalf of my clients. They are too numerous to mention here, but there are a few will note:
Booking room videos are gaining in popularity among police departments. Many police stations videotape arrested suspects some time after the arrest , where their speech can be clear and their balance is fairly normal, in spite of police testimony in court to the contrary. As a defendant, you will want that videotape.
Increasingly, for some unknown reasons, police are failing to mirandize suspects in DUI cases. This is illegal.
It is generally recommended as protocol that police conduct a proper and reasonable observation of the suspect for,say, at least twenty minutes before administering the breath test This observation period lends more credibility to the validity of the test.
The police officer must be properly trained to administer all drunk driving tests, whether they be field sobriety test or machine tests. Police are frequently improperly trained.
