In this federal case involving the U. S. Border Patrol in San Diego County, California, the 9th Circuit U. S. Court of Appeals ruled on September 12th, 2013 that even if a defendant gave a law enforcement office consent to search his cellphone, the officer does not have the right to answer the defendant's calls and pretend to be the defendant. Such actions by the law enforcement officer are in violation of the 4th Amendment to the U.S. Constitution.
