For a landlord to be sued in a lead paint case can be a devastating experience, both financially and emotionally.  I have found over several years that many landlords are simply unaware of the potential legal and financial hazards that can exist in the purchase and rental of pre-1978 built residences in cities such as Baltimore, Washington, D.C., Philadelphia, New York and Boston. Because of their long-term exposure to lead (Pb) and lead-based paint, these Northeast U.S. metropolitan areas are frequently considered to be "ground zero" for lead and lead-based paint claims.

The keys to a landlord avoiding and/or surviving these claims include : (1) research on the property and the local, state and federal lead paint laws and regulations (before you purchase the property, preferably); (2) preparation for the role of being a landlord for pre-1978 built residential properties in these cities; (3) proper maintenance by lead-certified and qualified workers on the residential properties; (4) lead paint liability insurance, preferably (if you can afford it, or even have a choice of acquiring it in your area); (5) lawful notice to residential tenants of lead paint risks (Title X compliance, et al.);  and good record-keeping on the property as well as the tenants.
