A 3-judge panel of the United States Court of Appeals for the Ninth Circuit in San Francisco ruled against President Trump and refused to reinstate the travel ban imposed by Trump largely against Muslim.
The Federal Appeals court ruling found that the Trump ban did not advance the nation's security, and that the administration had not pointed to any evidence that anyone from the seven banned nations had committed terrorism in the United States.
The court's decision also rejected the administration's claim that courts are powerless to review a president's national security determinations. Judges do have a crucial role to play in a constitutional democracy, the 9th Circuit panel said in it's decision.
" It is beyond question that the federal judiciary retains the authority to adjudicate constitutional challenges to executive action," the judges wrote.
