Baltimore is considered by many commentators to be "gound zero" for lead paint poisoning claims in
the United States. Two of the primary reasons for this dubious distinction are (1) the large number of existing pre-1978 built houses and apartments in the city and (2) the prior long-time heavy industrial use of lead (Pb) in the metropolitan area. In sum, according to many people, lead is essentially everywhere in the Baltimore metropolitan. But, let's be clear, that does not necessarily mean that all lead poisoning victims in Baltimore are the fault of residential rental landlords. In fact, the interpretation could just as well be the opposite.
I tell all of my landlord clients that the 4 simple keys to avoiding and defending successfully aginst lead paint and lead poisoning claims are :
(1) Careful investigation of the rental property and its history prior to purchasing it;
(2) Attentively good maintenance of the property;
(3) Lawful and proper notice to the tenants about any lead content in the property [see Federal Law TITLE 10]; and
(4) Consistent and proper record-keeping on both the tenant as well as the rental property.
Ther are other tips that I advise my clients of, but the aforementioned four keys are a good start for you Call me with any questions. The contents of this blog are for informational purposes only, and not designed or intended as legal advice.
