HABEAS CORPUS: The 9th Circuit panel reversed the lower District Court's denial of a 28 USC Section 2254 habeas corpus petition alleging prosecutorial misconduct when the prosecutor knowingly elicited and then failed to correct false testimony. The defendant, according to the appeals court, must now be either retried or released from detention.
