The plaintiff was 6 years old when she underwent a kidney transplant. In their complaint she and her parents alleged that the transplant resulted from medical malpractice on the part of the defendant pediatrician in failing to timely diagnose and treat the child's kidney failure.
The defendant maintained that the minor plaintiff's kidney developed suddenly and there were no indications of the disease at the time in question.
The plaintiff's experts testified that the defendant pediatrician deviated from the required standard of care in failing to recognize the significance of the elevated protein levels ( at least four urinalysis tests were performed showing excessive protein in the minor child's urine) and failing to order further diagnostic testing. Such results, as alleged by plaintiffs revealed that the child was suffering from kidney disease.
The plaintiff's doctors and expert witnesses, as well as defense witnesses, testified that the little girl will probably require at least three additional kidney transplants in the future, as a transplant will typically only function for a limited period of time. The plaintiff's experts also testified that the minor plaintiff's kidney transplant will affect her dailyactivities and will negatively impact her future earning capacity.
