$2,440,000.00 JURY VERDICT in Primary Care Doctors Malpractice Case involving Wrongful Death. Principal Allegation: Failure to offer patient colon cancer screening results in
delayed diagnosis of colon cancer; Metastatic colon cancer; Wrongful death of 56-year-old female patient.
In this medical malpractice case the deceased Plaintiff's Estate ("Plaintiff") alleged that the defendant primary care doctors failed to timely diagnose colon cancer in a 56-year-old female patient who subsequently died of metastatic colon cancer. The physician defendants denied the allegations of negligence, maintaining that colon cancer screenings were offered on multiple occasions to the plaintiff who failed to undergo the procedure.
In sum, the Plaintiff brought this lawsuit against the defendant primary care physicians alleging that they were negligent in failing to offer her preventative colon cancer screenings prior to her diagnosis of colon cancer and in failing to timely diagnose her colon cancer, thus deviating from established acceptable standards of preventative care. The defendant physicians denied the allegations of negligence and maintained that the patient was offered and advised to undergo colonoscopies on at least ten occasions. However, defendant physicians' medical records failed to support the defendants' contentions and made no mention of any such recommendation of colon screening.
The case proceeded to jury trial, at which the jury found for the Plaintiff and awarded judgment in the
amount of $ 2,440,000.00.

BABY'S SKULL FRACTURED DURING DELIVERY.
During labor dilation of the uterus was reported to be 4.0, with effacement at 50 and the station was -2. One hour and a minute later contraction frequency was a 3 and contraction duration was 60-90.
At 23:53 hours --- 52 minutes later --- contraction frequency was 3 - 4 and duration was 40 -100. two minutes later the patient requested an epidural for pain. Thirteen minutes after that, the pregnant mother was positioned on the side of the bed for the epidural which was placed 15 minutes later. The
mother was instructed to lie back down as soon as the contraction stopped. The mother was moaning and according to the nursing notes she asked the nurse, " Is it time? " The patient (pregnant mother)
reports that she said, "It is ready to come ."
The patient was then encouraged to lie down in the bed for SVE and the obstetrical teaching service was called for delivery. Within one minute the baby literally fell out onto the floor sustaining a hematoma and skull fracture. The attending nurse's notes indicates that the patient did NOT push.
Question: Should the patient have been monitored more closely to prevent this injury to her new-born baby ?
ANSWER : Yes. Definitely.

However, when that paint is disturbed, problems can begin to occur. Certainly for pre-1978 built residential units, they should br checked regularly for chipping, peeling or deterioration of paint, and any issues addressed immediately by professionals. Areas of the residential unit where painted surfaces rub together, like windows, should be regularly checked.
The EPA says, the residential maintenance person should carefully remove any paint chips or dust with a wet paper towel. Wipe down flat surfaces like window sills at least weekly with a wet paper towel, and then discard the towel.

Nationally, courts have begun to recognize that a defendant landlord still has the right to question causation and thereby avoid liability or at least mitigate its damages in lead-paint poisoning cases. This can be true even where there is evidence of lead exposure and the landlord had actual or constructive notice of the condition.
For example, a landlord who has been negligent in dealing with lead hazards presented by paint is clearly entitled to challenge causation by showing that the infant plaintiff ingested other lead-containing substances during the relevant time periods.

The plaintiff was 6 years old when she underwent a kidney transplant. In their complaint she and her parents alleged that the transplant resulted from medical malpractice on the part of the defendant pediatrician in failing to timely diagnose and treat the child's kidney failure.
The defendant maintained that the minor plaintiff's kidney developed suddenly and there were no indications of the disease at the time in question.
The plaintiff's experts testified that the defendant pediatrician deviated from the required standard of care in failing to recognize the significance of the elevated protein levels ( at least four urinalysis tests were performed showing excessive protein in the minor child's urine) and failing to order further diagnostic testing. Such results, as alleged by plaintiffs revealed that the child was suffering from kidney disease.
The plaintiff's doctors and expert witnesses, as well as defense witnesses, testified that the little girl will probably require at least three additional kidney transplants in the future, as a transplant will typically only function for a limited period of time. The plaintiff's experts also testified that the minor plaintiff's kidney transplant will affect her dailyactivities and will negatively impact her future earning capacity.

RIGHT ARM PARALYSIS POST ANTERIOR CERVICAL DISCECTOMY.
This case presents a 79-year-old male who had cervical stenosis and spinal cord compression C3 - T1. The surgeon performed an anterior cervical discectomy and fusion with allograft bone and plate C3-C6. Postoperatively he was noted to have increased weakness of his right arm, primarily in the deltoid and biceps as well as some mild weakness in his right lower extremity.
He was sent to rehab where it was discovered he had clear fluid leaking from the incision. He was transferred to the medical center 5 days later where doctors did a repair of the spinal fluid leak and repaired a C4 fracture that was discovered just prior to surgery.
The patient continues to have physical therapy and electrical stimulation, however progress of his right arm has been slow. Due to his disability he is no longer able to work at his job at an insurance company..
Opinion: Even though surgery of any type can be problematic for a patient, post-operative paralysis of this nature appears to be abnormal -- and thus raises the issue of whether the standard of care was violated for this kind of surgery.

This case involves a stroke victim's claims that delayed treatment by doctors caused further damage to him. The plaintiff, was a 62-year-old white male who had a history of diabetes, sleep apnea, hypertension, obesity and diabetic ketoacidosis. He suffered a stroke upon waking up in the morning. The plaintiff's wife witnessed her husband's stroke and called an ambulance for transportation to the defendant hospital. Plaintiff arrived at the hospital approximately 90-minutes after awakening.
Expert Opinion: Without more information, it would appear that plaintiff was a proper candidate for intravenous recombinant tissue plasminogen activator (t-PA), and any failure by doctors to offer t-PA therapy increased the risk of debilitating short-term and permanent sequelae from the patient's ischemic stroke.
The available data prior to and after the date of the stroke event support the fact that the plaintiff would have had a better chance had he been treated with t-PA than without t-PA for obtaining clinically meaningful improvement.
