LEAD PAINT DEFENSE - A PRIMER : MARYLAND & D.C.'s CHARLES JEROME WARE, DEFENSE ATTORNEYS & COUNSELORS

www.charlesjeromeware.com     "Here to make a Difference." We know lead-paint defense.

If you are a residential landlord who has been sued in a lead paint liability action, call premier defense attorney Charles Jerome Ware at (410) 720-6129. He and his staff can help you.

The history of the use of lead-based paint started many years ago in Europe.

Its use in the United States probably began at least as early as Colonial times. It was officially outlawed for residential and consumer use in the United States by the federal government in 1978.

When lead-based paint was marketed before being outlawed for residential and consumer use in 1978, it was a problematically legal product in great demand because it was washable and durable, etc. Even though some studies existed, particularly in Europe, that lead (Pb) could be harmful to the human body when ingested,  lead paint was nevertheless endorsed by the United States government, states, and local governments. In fact, lead paint was specified for use on government buildings until the mid-1970s..

The use of lead paint for building purposes is alleged to have peaked in the United States in 1922; and by 1940 the use of "white lead" paint pigments for interior use was on the way out.

Other points to remember:

- Use of "white lead paint" in the U.S.began in Colonial times and ultimately peaked in about 1922.
- In 1951, Baltimore, Maryland banned the use of lead pigment in interior paint in Baltimore housing. This was the first such restriction in the United States.
- In 1971, the federal Lead Poisoning Prevention Act was passed.
- In 1978, the federal government banned consumer uses of lead paint

Ingestion of lead paint is most dangerous in children up to the age of 7.
Residential landlords are the most common individuals and entities to be sued for alleged lead poisoning.
Residential landlords for housing built before 1978 are highly encouraged to follow state and federal laws closely regarding lead paint. Ramifications for violations can be very costly.
