There are several lead-based paint disclosure laws, both Federally and for each state and the District of Columbia. A few are as follows:
(1) In 1992, Congress passed the Residential Lead-based Paint Hazard Reduction Act, also known as Title X, to protect families from exposure to lead from paint, dust, and soil. Section 1018 of this law directed the Department of Housing and Urban Development (HUD) and the U.S. Environmental Protection Agency (EPA) to require the disclosure of known information on lead-based paint and lead-based paint hazards before the sale or lease of most housing built before 1978.
(2) Maryland's Reduction of Lead Risk in Housing law requires owners of rental properties built before 1950 to register their residential units with the Maryland Department of the Environment (MDE), distribute specific educational materials, and meet specific lead paint risk reduction standards at certain triggering events.
(3) Generally, we advise our clients to issue their own statement with, among other things, the following information:
Housing built before 1978 may contain lead-based paint. Lead from paint, paint chips, and dust can pose health hazards if not managed properly. Lead exposure is especially harmful to young children and pregnant women. Before renting pre-1978 housing, lessors must disclose the presence of known lead-based paint and/or lead-based paint hazards in the dwelling. Lessees must also receive a Federally-approved pamphlet on lead poisoning prevention.
Always make sure the recipient signs something acknowledging receipt of the information.
