U.S. (FTC AND CFPB) VOW TO FIGHT ABUSIVE BILL COLLECTORS:

The Federal Trade Commission (FTC) and the Consumer Financial Protection Bureau (CFPB) are promising to crack down on questionable debt collection practices by some of the country's biggest lenders --- including, among others, Capital One, J.P. Morgan Chase, Wells Fargo, Bank of America, PNC, etc. as well as other companies such as Macy's and Expert Global Solutions (EGS), the world's largest debt collection agency.

On Tuesday, July 9th, 2013, the FTC won a $3.2 civil penalty against Expert Global Solutions as well as a cease and desist order prohibiting EGS from harassing and abusing debtors by engaging in practices such as calling debtors multiple times a day.  On its website, EGS says it is a holding company for a leading accounts receivable management company.  Three EGS subsidiaries were also involved in the civil penalty settlement: NCO Financial Systems, Inc., ALW Sourcing LLC, and Transworld Systems, Inc.

This new push by federal regulators comes after revelations that some of the same practices that have haunted the foreclosures of homes — like robo-signing and faulty documentation — have cropped up in efforts to recoup delinquent credit card debt.

The debt collection practices of banks and lenders have long existed in a kind of regulatory gulf. The primary federal law that governs how companies pursue consumers behind on their bills does not apply to firms that are trying to recoup money that they lent directly to a consumer.
